Dzhokhar Tsarnaev, 19, the Boston Marathon bomber suspect, who was apprehended last Friday, after he was found wounded in a boat in Watertown, Boston, after the Boston Marathon bombings that killed three people and injured nearly 200 others, came to America legally by claiming asylum with his father.

On page 606 of the Gang of Eight’s 844-page legislation called, “Border Security, Economic Opportunity, and Immigration Modernization Act,” under “Subtitle G—Interior Enforcement, Sec. 3701: Criminal street gangs,” we learn that gang members (with no prior convictions) can apply for a waiver by simply “renouncing” their associations with street gangs.

Sen. Rubio, taking a page from Sen. John McCain (R-Ariz.), also claims currently there is a defacto-amnesty which is why America needs a pathway to citizenship. The truth is there is a defacto-amnesty—thanks to President Obama’s policies which is why Immigration and Custom Enforcement (ICE) agents have filed a lawsuit against Department of Homeland Security chief Janet Napolitano and ICE Director John Morton, who are preventing them from upholding the law and doing their jobs—because of President Obama’s defacto-amnesty policies. Why isn’t Sen. Rubio helping the good ICE agents instead of making their lives worse?

According to a draft of a White House immigration proposal obtained by USA TODAY, leaked over the weekend, the Obama administration “would allow illegal immigrants to become legal permanent residents within eight years.” Within eight years? That is not the back of the line.
